Missouri Attorney General Andrew Bailey has filed a lawsuit against New York alleging that the state has violated the First Amendment right of Missourians to hear from Former President Trump during the 2024 presidential election. The lawsuit also claims that New York's actions have negatively impacted Trump's ability to campaign for president, thereby sabotaging the ability of Missourians to hear from him and make an informed decision when voting for a presidential candidate.

Bailey's lawsuit has been filed with the Supreme Court, and it seeks to declare that New York's restrictions on President Trump's ability to campaign unfairly intrude into the presidential election, to lift any gag orders on the former president, and to halt his sentencing until after the presidential election. Bailey argued that he would not stand by idly while New York's prosecutors hold Missouri voters hostage in the upcoming election, saying that he is committed to ensuring that every Missourian can hear from and vote for their preferred presidential candidate.

The lawsuit outlines three violations, including the interference with the presidential election in other states, the violation of the First Amendment, and the unlawful change of election rules just months before the election. The lawsuit comes only a month after Alvin Bragg, New York's Manhattan DA, won a guilty verdict against Trump on 34 counts of falsifying business records in the first degree, which carries a maximum sentence of 136 years in prison. Trump has pleaded not guilty to all counts and requested a delay to his sentencing.

Bailey called the lawsuit "lawfare" that is "poisonous to American democracy." He believes that the American people should be allowed to participate in presidential elections freely, without any interference from New York. He criticized Bragg as having been involved in a lawsuit against Trump when he worked at the New York Attorney General's office, then running for his current position by promising to prosecute Trump based on that experience.

Bailey also filed a motion of preliminary injunction, asking the court to stop any further actions related to the New York case until the American people have had their vote during the election.
As the legal battle continues, Trump is seeking to overturn his criminal conviction after the U.S. Supreme Court ruled that a former president has substantial immunity for official acts committed while in office. Trump has also requested to delay his sentencing, which has been set for September 18 at 10 a.m., after the Republican National Convention where he is expected to be formally named as the 2024 GOP presidential nominee. Bragg did not oppose the request, but he said that Trump's appeal to overturn his conviction is without merit.
