Rep. Alexandria Ocasio-Cortez, D-N.Y., is under federal investigation for allegedly employing an illegal alien on her congressional staff and for hosting events that reportedly assisted illegal immigrants in evading federal immigration enforcement, according to Border Czar Tom Homan, as the Gateway Pundit reported[1].
Homan made the announcement during an interview Monday on the Benny Johnson Show, confirming that two separate allegations against the New York Democrat are now under review.

“It’s being looked at,” Homan said when asked about Ocasio-Cortez allegedly employing an illegal alien. “Can’t comment past that. I’m aware of it. We’ve asked ICE to drill in on that case.”
The individual in question, Diego de la Vega, previously served as deputy communications director in Ocasio-Cortez’s congressional office and was earlier involved in her 2021 campaign.
According to The Gateway Pundit, de la Vega self-deported to Colombia in December 2024, just weeks after President Donald Trump won the 2024 presidential election.
In addition to the employment issue, Homan stated that Ocasio-Cortez may have crossed legal lines by organizing webinars intended to teach illegal aliens how to avoid detection or arrest by Immigration and Customs Enforcement (ICE) agents.
“She’s really educating them on how to avoid prosecution,” Homan said.
“Because there are statutes on the books when you knowingly hinder your removal—that’s a crime. We have instructed ICE to start prosecuting these cases.”

In a prior interview on Fox News’ The Ingraham Angle in February, Homan revealed that he had contacted the Deputy Attorney General’s office urging a formal review into Ocasio-Cortez’s actions.
“At what level is that impediment?” Homan said at the time. “I’m not an attorney… Is that impeding our law enforcement efforts? If so, what are we going to do about it? Is she crossing the line?”
Ocasio-Cortez has not publicly responded[5] to news of the investigation. In a past statement to Migrant Insider about de la Vega’s departure, she said, “Diego is amazing. We love him.”
President Trump’s administration has made immigration enforcement a top priority, and under his leadership, border crossings have declined to the lowest levels in a generation.
The Department of Justice has not yet released a public statement on the status of the investigation.
