The central argument is that the hand-counting rule violates state law, with the board allegedly overstepping its authority in approving the measure. This rule, which passed with a narrow 3-2 vote from supporters of Republican candidate Donald Trump, aims to ensure that the totals from hand counts match those recorded by voting machines.

The complaint, lodged in Fulton County Superior Court, states: “If the Hand Count Rule is allowed to go into effect, the general election will not be orderly and uniform.”

The DNC asserts that larger counties may experience significant delays in reporting vote counts. Furthermore, the complaint highlights concerns over election officials struggling to adapt to new procedures introduced too late in the game, as well as potential security risks to the ballots themselves.

Compounding their worries, the DNC argues that delays stemming from the hand-counting process could provide opportunities for “bad-faith actors” to claim that fraud has tainted the election results. The rule in question requires each voting precinct to have the poll manager and a pair of workers separate ballots into stacks of 50 for hand-counting. The three must reach a consensus on the total count and verify that it aligns with the machine tabulation.
