In the latest development in the case of People v. Trump, the defense team has filed a pre-motion letter dated July 1, 2024, seeking to set aside the verdict based on a recent Supreme Court decision. The letter was addressed to Judge Juan Merchan of the New York State Supreme Court.

The defense cited the July 1, 2024, Supreme Court decision in Trump v. United States, 2024 WL 3237603, as the basis for their motion. They requested until July 10, 2024, to submit a memorandum of law supporting their motion. While the defense indicated no objection to adjourning the July 11, 2024, sentencing date, they emphasized that the request to file moving papers by July 10, 2024, implicitly seeks to adjourn the sentencing hearing until a resolution is reached on the motion.

 

The District Attorney’s office did not oppose the request for leave to file the motion or the implied request to adjourn sentencing. The prosecution requested that the court set a deadline of July 24, 2024, to file and serve their response to the defense’s motion.

 

As a result, the July 11 sentencing date will most likely be vacated pending further proceedings. This case continues to evolve as both parties prepare for further legal battles in the courtroom.
