According to Cannon, the appointment of Smith represented a breach of the Constitution, highlighting the lack of judicial scrutiny in the Executive's trend of selecting "regulatory" special counsels in recent times.

Jack Smith was doing what his boss, Attorney General Merrick Garland, instructed him to do.. it’s now called “law fare” but what they did is nothing less than false prosecution of Biden’s primary political opposition, and nothing less. They are doing EXACTLY what they claim Trump will do, but they are ACTUALLY doing it.

Let’s be honest here. Jack Smith and Attorney Gen Merrick Garland knew 2 years ago this action was unconstitutional and moved forward anyway. This is not a surprise by any stretch.
The real questions about this should then be why did Merrick Garland proceed.
