On October 10, 2023, Delta Police Department Officers were dispatched to 157 Bert Street in Delta, Colorado, after reports of a "strange man" in the driveway who had entered a house through a window. The first officer on the scene was Mark Bowen, who engaged in a confrontation with 43-year-old Jeremy Kuzov.

Kuzov was agitated, claimed his child had been killed, and refused to obey Bowen's commands. Kuzov eventually charged Bowen, hitting him in the head and attempting to take his taser. Bowen then drew his weapon, ordered Kuzov to comply, and shot him when he didn't listen.

The DA ruled that Bowen used justified force in self-defense and defense of others. Kuzov was diagnosed with left rib fractures and a lung contusion but ultimately survived the incident.

Toxicology reports also found drugs in Kuzov's system, including amphetamines, methamphetamines, opiates, and benzodiazepines.
