Lia Thomas, the transgender swimmer who gained notoriety for clinching multiple NCAA women’s swimming titles in 2022, has been excluded from participation in the 2024 Summer Olympics following a legal defeat in a clash with the international governing body of swimming.
Striving to challenge the recent stringent regulations imposed by World Aquatics on transgender athletes, Thomas sought legal recourse at the Court of Arbitration for Sport in a bid to overturn the restrictions that prevent individuals like Thomas from competing in global tournaments and disqualify him from being considered for a spot on the U.S. Women’s Swim Team, as reported by the Guardian.

Arguing that the rules defy the Olympic charter and the World Aquatics constitution, Thomas attempted to have them declared as “invalid and unlawful.”
However, the court dismissed Thomas’ claims, asserting that he lacked the standing to contest his eligibility to partake in World Aquatics competitions due to not currently being a member of the organization.
The regulations were introduced in response to the controversy stirred by Thomas’ triumph in the 2022 NCAA championship, introducing criteria that disallow males who underwent a gender transition after puberty from competing as transgender females. This stipulation effectively excludes Thomas and a majority of transgender athletes from participating.

Despite World Aquatics not having the opportunity to present the scientific basis for their ban following the dismissal of Thomas’ case due to lack of standing, the organization maintains that scientific data demonstrates the inherent physical advantages males who underwent puberty possess over the female body in swimming, including superior muscle structure, lung capacity, and stamina.
In alignment with the stance of various other sports bodies, several disciplines have enacted rules prohibiting individuals born male to compete as female athletes. In September 2022, international rugby instituted a regulation preventing male-born athletes from competing in women’s categories, while professional disc golf enforced a similar ban in December 2023. British Cycling likewise enforced a policy in May of the previous year to prohibit male athletes from participating in female competitions.
