The dispute erupted as Costello audibly and visibly expressed disapproval when the prosecution’s objections to his testimony about Michael Cohen were sustained by Merchan.

Following one such reaction, Merchan addressed Costello, stating, “I’m sorry?” before dismissing everyone from the court.

“I want to discuss proper decorum in my courtroom,” Merchan emphasized after the jury exited. “You don’t say strike it because I’m the only one who can strike it.”

Merchan instructed Costello not to respond, roll his eyes, or display any reaction to his rulings.

Before the jury returned, Costello was seen looking at Merchan, which prompted the judge to question, “Are you staring me down?”

Subsequently, Merchan ordered members of the press to be removed from the courtroom, while Trump’s representatives were permitted to remain.

After a period, both the press and the jury were readmitted, and Costello’s testimony recommenced.
